Booking Conditions

The conditions applicable to every reservation contract concluded with Capra Adventures.
These Booking Conditions govern every reservation contract concluded between Capra Adventures ("the Operator") and the client ("the Client") for guided expeditions, tours and related travel services. They are drafted in accordance with Law No. 04/L-176 on Tourism, Law No. 06/L-034 on Consumer Protection and Law No. 04/L-077 on Obligational Relationships of the Republic of Kosovo, and shall be read together with our Terms and Conditions and our Privacy Policy.
1. Booking Procedure
A booking is initiated when the Client submits a reservation request through the website, by email or by any other accepted channel. The contract between the Operator and the Client is formed only upon issuance of a written booking confirmation by the Operator and receipt of the deposit referred to in Section 3 below.
2. Information to be provided by the Client
The Client warrants the accuracy and completeness of the information provided at the time of booking, in particular the names of all participants as they appear on their identification documents, dates of birth, nationality, contact details, dietary requirements and any health conditions or impairments relevant to participation in mountain activities.
3. Deposit and Final Payment
Unless otherwise specified in the booking confirmation, a non-refundable deposit of thirty per cent (30 %) of the total price is payable within seven (7) calendar days of the booking confirmation. The balance is payable no later than thirty (30) calendar days before the start date of the tour. For bookings made within thirty (30) days of departure, the full price is payable upon confirmation.
4. Prices and Price Revision
Prices are expressed in Euro (€) and, unless expressly stated otherwise, include all taxes applicable under the law of the Republic of Kosovo. The Operator reserves the right to revise the price of a booked tour, prior to the start of the tour, only on account of variations in: (a) transport costs (including fuel); (b) taxes or fees imposed by third parties; or (c) exchange rates relevant to the tour. No price revision shall be made within twenty (20) days of the start date of the tour.
5. Inclusions and Exclusions
The services included in the price are those expressly listed in the tour description and in the booking confirmation. Unless expressly stated otherwise, the price does not include: international flights to and from Kosovo, travel and medical insurance, costs related to the issuance of passports and visas, meals not specified in the itinerary, beverages, tips, personal expenses and any optional activity.
6. Cancellation by the Client
If the Client cancels the booking, the following cancellation charges, calculated as a percentage of the total price of the tour, shall apply:
- More than 60 days before the start date: loss of the deposit only;
- Between 60 and 31 days before the start date: 50 % of the total price;
- Between 30 and 15 days before the start date: 75 % of the total price;
- Less than 15 days before the start date or no-show: 100 % of the total price.
All cancellations must be notified to the Operator in writing. The date of cancellation shall be the date of receipt of the written notice by the Operator.
7. Cancellation by the Operator
The Operator may cancel a tour where: (a) the minimum number of participants required to operate the tour is not reached; (b) circumstances of force majeure prevent the safe conduct of the tour; or (c) the Client has materially breached these Booking Conditions. Where the cancellation is attributable to the Operator and not to force majeure or to the Client, the Client shall be entitled to a full refund of all amounts paid or, where possible, to an alternative tour of equivalent value.
8. Modifications to the Itinerary
The Operator reserves the right to modify the itinerary, the order of activities or the accommodation provided where weather, safety, operational or regulatory considerations so require. Any such modification shall be communicated to the Client without undue delay and shall not entitle the Client to any compensation, provided the overall character and value of the tour are preserved.
9. Travel and Medical Insurance
Comprehensive travel and medical insurance, including coverage for mountain activities, accident, illness, evacuation and trip cancellation, is mandatory for participation in our tours. The Client is solely responsible for taking out adequate insurance and for verifying its scope and validity. The Operator reserves the right to refuse participation to any Client who is unable to evidence valid insurance.
10. Health, Fitness and Conduct
Mountain activities entail inherent risks. By booking, the Client confirms that he or she is in adequate physical condition for the level of difficulty of the chosen tour and shall disclose to the Operator any pre-existing condition relevant to the activity. The Operator reserves the right to exclude from any activity, without refund, any participant whose conduct, condition or behaviour endangers the safety of the group or jeopardises the proper conduct of the tour.
11. Travel Documents
The Client is solely responsible for holding valid travel documents (passport, identity card, visas where required) for all countries visited during the tour. The Operator shall not be liable for any consequence arising from the Client's failure to hold such documents.
12. Liability
The Operator is liable for the proper performance of the obligations resulting from the contract, regardless of whether such obligations are to be performed by the Operator itself or by other service providers. The Operator's liability shall be limited to the price of the tour, except in cases of death, personal injury or wilful misconduct, where liability shall apply in accordance with the imperative rules of Kosovo law.
13. Force Majeure
Neither party shall be held liable for non-performance attributable to force majeure, including but not limited to natural disasters, extreme weather, avalanches, epidemics, governmental measures, border closures, war or civil unrest. In such circumstances, the Operator shall use its reasonable efforts to offer the Client an alternative arrangement of equivalent value or, failing that, a refund of unused services net of unrecoverable costs.
14. Complaints
Any complaint relating to the performance of the contract must be communicated to the Operator's local representative without undue delay during the tour, so that a remedy can be sought on site. Any unresolved complaint must be submitted in writing within fifteen (15) calendar days following the end of the tour. Complaints submitted after this period may not be admitted.
15. Personal Data
The processing of personal data collected for the purpose of booking and operating the tour is governed by our Privacy Policy.
16. Governing Law and Jurisdiction
These Booking Conditions are governed by the law of the Republic of Kosovo. Any dispute arising out of or in connection with the booking contract that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Kosovo, without prejudice to any imperative consumer-protection provisions.
